Divorce in the Media

Fraud in divorce has been used quite a bit in the media lately.  The most common usages that I have heard have been regarding either 1) fraud in the marriage or 2) fraud in an agreement before the marriage – the prenuptial agreement.  Fraud is one of several grounds for annulment of a marriage.  When a marriage is annulled there is no need for a divorce.  It is as if the marriage never happened.  Fraud that is claimed within the marriage, is not claimed for an annulment but in the divorce and can relate to how the property in the marriage is divided. … [Read more...]

Tip of the Week – Temporary Hearing

A temporary hearing is a hearing during a case, while the case is pending.  The hearing allows parties a limited amount of time to put on evidence about specific issues that need to be decided before the case is finished.  At the conclusion of the temporary hearing, the Judge will make a ruling about the orders to be in effect until the final orders are entered at the end of the case.  Some of the questions that can be answered and issues that can be decided in a temporary hearing are child support, spousal support, who will live where and parenting schedules. … [Read more...]
