Fraud in divorce has been used quite a bit in the media lately.  The most common usages that I have heard have been regarding either 1) fraud in the marriage or 2) fraud in an agreement before the marriage – the prenuptial agreement.  Fraud is one of several grounds for annulment of a marriage.  When a marriage is annulled there is no need for a divorce.  It is as if the marriage never happened.  Fraud that is claimed within the marriage, is not claimed for an annulment but in the divorce and can relate to how the property in the marriage is divided.
