What Makes an Agreed Divorce Work?

January is a month that typically sees people stressed from the holidays seeking divorce information.  It’s common to find out that a couple, or just one person, is considering divorce after feeling the stress from being together over the holidays, the financial stress, and stress related to work.  And 2021 might find more people with divorce questions and looking for divorce information.  At our office, Jill O’Connell is committed to helping those with divorce questions find answers.  One divorce topic that we are going to talk about today is how agreed divorce works.

An agreed divorce can really be anything from agreeing to everything about the divorce including dividing property, what happens to the debts, and children to reaching an agreement later and right up until there is a trial in the divorce.  Most commonly this question means couples agreeing about some or all of the divorce in the beginning stages of the divorce, and that’s what this post topic will be.  We have One on Wednesday videos that talk about some other aspects of that you can find here.

Agreed to Divorce and Everything Else

If a couple reaches agreement that divorce is the only option available to them, and then is able to agree on dividing their property, deciding what is going to happen with their debts, and if they have kids, child support, and parenting time in our office the divorce can move ahead very quickly.  We will get all of the information from one of the spouses (because divorce lawyers can’t represent both spouses), prepare the Original Petition for Divorce, and all the additional pleadings that are necessary based on that divorce.  Texas has a divorce waiting period that is 60 days.  We can very often finish that type of agreed divorce as quickly as 61 days.

Both Agree to Divorce

If a couple agrees that divorce is the only option for them but hasn’t fully agreed to everything else and wants to have an agreed divorce, we have options available for an agreed divorce also.

We can work with one of the spouses and assist them to work through the additional parts of the divorce based on their individual situation.  This can mean that Jill O’Connell assists as little as providing the needed information to one spouse who works through the divorce information process with the other spouse or as involved as Jill O’Connell taking on a more involved attorney assisted divorce part in working with the other spouse or the other spouse’s attorney.  This will vary based on each specific divorce based on the needs in that situation.  In our office, we will work towards an agreed divorce with our client in the way that they need to be assisted.

In both agreed divorce situations, Jill O’Connell works with her divorce client to determine the divorce goal(s) and create a divorce plan and/or divorce strategy as needed based on that particular client and the situation in that divorce.

And, this post is being written in January 2021 so at our office we are meeting with clients online, and able to begin and finish divorces using online resources.

Whether a couple has all the divorce details worked out or the divorce details still need work, an agreed divorce is possible.
